Nature of the transaction. Rent-to-own at Appliance Mart is a rental-purchase transaction governed by the Florida Rental-Purchase Agreement Act (Chapter 559, Part X, Florida Statutes). It is a rental agreement with an option to purchase. It is not a loan, a credit sale, financing, or a retail installment contract, and entering a rental-purchase agreement is not an extension of credit.
Ownership. You will not own the rented item until you have made the total number of payments necessary to acquire ownership as stated in your agreement, or until you exercise your early purchase option. Until then, Appliance Mart owns the item. Acquiring ownership is optional — you may rent for as long or as short a time as you choose.
Total cost. Renting to own costs more than paying cash for the same item. Before you sign, your agreement will state the item's cash price, the amount and timing of every payment, all other charges, and the total of all payments necessary to acquire ownership, so you can see the complete cost up front. All payments are subject to applicable Florida sales tax.
Early purchase option. You may purchase your item at any time during the agreement at the early purchase price stated in your agreement — the earlier you exercise it, the more you save compared to completing the full payment schedule.
Your right to return and to reinstate. You may end your agreement at any time, without penalty, by returning the item and paying any amounts already due. If you miss a payment, Florida law and your agreement give you the right to reinstate the agreement within a stated period — keeping all the payments you have made counted toward ownership — by bringing your account current, including any reinstatement and redelivery charges stated in the agreement.
Condition of items. Items available for rent-to-own may be new or previously rented. The condition of your specific item will be disclosed in your agreement before you sign.
Service. While your account is current, Appliance Mart is responsible for maintaining your rented item in good working order at no charge to you, except for damage caused by misuse, abuse, or neglect.
Approval and “no credit needed.” “No credit needed” means a rental-purchase agreement is not a credit transaction and no established credit history is necessary to apply. It does not mean approval is guaranteed. Approval is based on verification of identity, income, residence, and personal references, and is valid for the period stated at approval. Approval amounts, item eligibility, payment amounts, and terms are set at the time of your agreement.
Automatic payments. An authorized debit/credit card or bank account for recurring automatic payments is required to activate a rental-purchase agreement. Your payment method is charged in the amounts and on the dates stated in your signed authorization. If an automatic payment is declined, you remain responsible for making the payment by another method to keep your account current.
Delivery and setup. Delivery timing depends on inventory availability at your store and confirmation of your information, and may vary by delivery address. Standard setup does not include connection of gas or water lines, electrical work, custom installation, or modification of your home; where a licensed connection is required, it is the customer's responsibility unless separately arranged in writing. Any delivery charge will be itemized in your agreement before you sign.
